To the US government the two british soldiers who was rescued in Basra must be defined as what is called "Illegal Combatants".
At least if you base your judgment on a document from Pentagon where Donald Rumsfeld says the following:
"... Had the Taliban worn uniforms, had the Taliban used weapons that were visible, had the Taliban functioned in a chain of command, had the Taliban done three or four other things that are the indicators or the criteria by which Geneva suggests it be judged as to whether someone is or is not a lawful or unlawful combatant ..."
Not that I think the two british "soldiers" should not have rights, but the prisoners at Guantanamo should have the same rights.
